By bidding in our auctions, you agree to the following terms and conditions:
All auctions are conducted by Aidan Delaney (ABN 51775234223), trading as Paddles Auctions (“Auctioneer”)
All bids and payments are made in Australian dollars (AUD). International bidders are responsible for any currency conversion fees charged by their payment provider.
Hammer prices are exclusive of GST where applicable. GST will be applied in accordance with Australian tax law and itemised on your invoice where required. GST is payable on the Buyer’s Premium
An 18% buyer’s premium will be added to the hammer price of all successful bids.
International bidders are responsible for any import duties, local taxes, or charges, as these are not included in the item price or postage cost.
In the event of any dispute arising in respect of the bidding — prior to, during, or after the close of the auction — the Auctioneer’s decision is final.
The Auctioneer accepts no liability for missed online bids, system downtime, or technical issues.
All goods are at the bidder’s risk from the fall of the hammer. Neither the Auctioneer nor the vendor shall be liable for any deficiency, damage, or loss arising thereafter. All reasonable efforts will be made by the Auctioneer to ensure the safe delivery of goods via domestic or international shipping. Insurance may be arranged upon request at the buyer’s expense.
Bidders accept responsibility for, and agree to indemnify, defend, and hold harmless the Auctioneer and its employees, officers, affiliates, subsidiaries, directors, agents, and representatives from any and all claims, losses, damages, liabilities, judgments, costs, and expenses (including legal fees) arising from or associated with the bidder’s use of the goods, site and including personal injuries or property damage incurred on the sale premises or during removal and transport of goods.
Item descriptions provided in the auction catalogue or advertising are believed to be accurate. However, neither those descriptions nor any statements made by the Auctioneer or its employees shall be considered a warranty, either expressed or implied. All goods are sold as is – where is – how is and with all faults, known, apparent, or otherwise. It is the bidder’s responsibility to determine the exact condition of each item.
These Terms & Conditions and any auction conducted by the Auctioneer are governed by and construed in accordance with the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia in respect of any dispute arising out of or in connection with these Terms or any sale conducted by the Auctioneer.
Inspections: As auctions are conducted online only, bidders may request additional information or photographs of lots. Please submit any requests at least 48 hours prior to the auction start time.
All sales are final, with no refunds, returns or exchanges offered.
While every effort is made to avoid withdrawal of goods after listing, the Auctioneer reserves the right to withdraw any item at any time before or during the auction. The Auctioneer also reserves the right to reject any and all bids at their sole discretion.
The Auctioneer reserves the right to cancel, postpone, or reschedule the auction at any time, without notice, for any reason.
Payment terms: Payment must be made within 48 hours of the sale’s completion. Goods must be paid for in full before shipping can be arranged.
If payment is made by credit card, debit card, PayPal, or any other electronic payment method, the bidder agrees not to initiate a chargeback or payment reversal without first contacting the Auctioneer to resolve the matter. In the event of an unjustified chargeback or reversal, the bidder remains liable for the full purchase amount, together with any merchant fees, administrative costs, recovery expenses, and legal costs incurred by the Auctioneer in recovering the funds. The Auctioneer reserves the right to provide relevant transaction records, correspondence, delivery confirmation, and these Terms & Conditions to the payment provider to dispute any chargeback.
Goods not paid for by the successful bidder may be re-listed at a subsequent auction. Any shortfall between the original successful bid and the resale price will be recovered from the original bidder.
A bid is a binding contract. Please only bid if you are serious and able to meet your financial obligations. The Auctioneer may, at their discretion, take legal action in response to unprofessional behaviour or failure to comply with these terms and conditions.
The Auctioneer maintains an email mailing list to notify customers about upcoming auctions. If you wish to stop receiving these emails, please forward the email to paddlesauctions@outlook.com with a request to be removed from the list.
